You can tackle suspects who aren't shooting at you. You can a warning shot if you get closer enough to sit while in pursuit. You can also shoot suspects in nonlethal areas repeatedly, such as the legs. You'll know if you successfully nonlethally subdued the suspect because Phelps will ask for an ambulance to the scene, rather than just the video of the coroner loading the body up.
